yield. If the road 300NASeattle was traveling on does not have a yield sign, then the driver approaching the yield sign must "yield" to passing traffic until it is safe to enter the intersection.
So unless it can proven through skid marks that 300NA was speeding, he should have a pretty solid case that the girl did not yield as she should have.
And given the light damage and the fact that he has two witnesses who state the girl did not yield give him better than 50/50 odds IMO. :-)
